Please read these Terms of Service ("Terms") carefully before using the Research37 platform and services operated by Research37 LLC ("us," "we," or "our").

1. Acceptance of Terms

By accessing and using the Research37 platform, including Survey37, Pricing37, Focus37, Diary37, and related services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.

2. Description of Service

Research37 is an AI-powered research platform offering multiple products designed for research, testing, and educational purposes:

  • Survey37 — AI-powered surveys with simulated AI respondent responses
  • Pricing37 — AI-powered pricing research (Van Westendorp, Gabor-Granger, and related methodologies)
  • Focus37 — AI-powered focus groups with synthetic agent personas in group discussions
  • Diary37 — AI-powered longitudinal diary studies with accelerated time simulation

These services use artificial intelligence to generate simulated research data. The platform is designed for research, testing, and educational purposes.

3. Use License

Permission is granted to temporarily use our services for personal or commercial research purposes. This is the grant of a license, not a transfer of title.

4. User Accounts

To use Research37, you must:

  • Create an account with accurate information
  • Maintain the security of your password
  • Be at least 18 years old or have parental consent
  • Not share your account credentials with others

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

5. Acceptable Use

You agree not to use Research37 to:

  • Create content that is illegal, harmful, or offensive
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to systems
  • Distribute malware or harmful code
  • Misrepresent AI-generated responses as human responses

6. AI-Generated Content

Research37 uses artificial intelligence to generate survey responses, pricing study data, focus group discussions, diary entries, and other research outputs. You acknowledge that:

  • AI-generated output is simulated and not from real humans
  • AI-generated output may contain inaccuracies or biases
  • You are responsible for how you use AI-generated data
  • AI-generated content should not be represented as human responses in published research without appropriate disclosure

7. Intellectual Property

You retain ownership of surveys, studies, discussions, content, and other materials you create. By using Research37, you grant us a license to process and store your content as necessary to provide the service.

Research37, Survey37, Pricing37, Focus37, Diary37, and their original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

8. Privacy and Data

Your use of Research37 is also governed by our Privacy Policy. We process personal data in accordance with applicable data protection laws. By using our services, you consent to such processing. We implement reasonable measures to protect your data against unauthorized access, loss, or disclosure. Data may be stored and processed in the United States or other regions where we or our service providers operate.

We engage third-party processors (such as cloud infrastructure, authentication, and AI providers) to help deliver our services. We require these processors to process your data solely on our instructions, in compliance with applicable data protection laws, and with equivalent privacy and security standards. They are contractually obligated not to use your data for their own purposes, including but not limited to advertising, marketing, model training, profiling, or selling or sharing your data with other parties. Third parties act as processors on our behalf and do not use your data for purposes beyond those necessary to provide our services.

9. Fees and Payment

Some features may require payment. If you purchase a subscription or use paid features, you agree to pay all applicable fees. Fees are non-refundable unless otherwise required by law or stated in our refund policy. We reserve the right to modify pricing with reasonable notice. Failure to pay may result in suspension or termination of your account.

10. Third-Party Services

Our services may integrate with or rely on third-party services (e.g., authentication, AI providers, cloud infrastructure). Your use of such services may be subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

11. Indemnification

You agree to indemnify, defend, and hold harmless Research37 LLC and its directors, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the services, your content, your violation of these terms, or your violation of any third-party rights.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RESEARCH37 LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, RESULTING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.

14. Termination

We may terminate or suspend your account at any time for violations of these terms, nonpayment, or at our sole discretion. Upon termination, your right to use the services will immediately cease. You may export your data prior to termination where such functionality is available. We may retain certain data as required by law or for legitimate business purposes.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last Updated" date. Your continued use of the services after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must stop using the services.

16. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

18. Entire Agreement

These terms, together with our Privacy Policy and any applicable subscription or service-specific agreements, constitute the entire agreement between you and Research37 LLC regarding the services and supersede any prior agreements.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or failures of third-party services or utilities.

20. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States and the State of Ohio, without regard to conflict of law principles.

You irrevocably consent to and submit to the exclusive jurisdiction of the state and federal courts located in Ohio for any dispute arising from these terms or the services. You waive any objection to venue or jurisdiction based on forum non conveniens or similar grounds. Any legal action shall be brought only in such courts, and you waive any right to a trial by jury. The prevailing party in any such action shall be entitled to recover its reasonable attorneys' fees and costs.
